Petition has been filed taking advantage of Sections 218 and 278 of Indian Succession Act, 1925, seeking Letters of Administration without Will relating to the property and estate of M.Saraswathy, who died intestate on 18.05.2021. 2.The petitioners are the children of the brother of her husband. However, this Court wanted an affidavit relating to her brothers and sisters and accordingly, an affidavit had been filed today, stating that there are no other Class 2 heirs apart from the petitioners herein, who can lay a claim to administer the estate left behind by late M.Saraswathy. After following due procedure, the petitioners were directed to tender evidence.

3.The 1st petitioner/Ganesh Veerappan, examined himself as PW-1. The legal heirship certificate of K.Manivel, the husband of M.Saraswathy was marked as Ex.P-2. His death certificate was marked as Ex.P-1. The death certificate of M.Saraswathy was marked as Ex.P-3. The details regarding the properties for which Letters of Administration are required were marked as Exs.P-4, P-5 and P-6. Ex.P-14 is another death certificate with respect to C.Chinna Pappa. C.V. 4.In view of the evidence presented, particularly also in view of the affidavit now filed which is taken on record, petition is allowed.

5. Letters of Administration without Will is granted relating to the estate of M.Saraswathy, to the petitioners.
