Order This Writ Petition has been filed directing the respondent to pay difference in leave salary and gratuity with 10 percentage interest as per the 15th wage settlement dated 29.5.2025 to the petitioners.

The petitioners were appointed in the 1st respondent-Corporation as Helper, Conductor and Drivers and after rendering nearly 24 -34 years of service, the petitioners retired from services in 2023, 2024 and 2025 prior to the 15th wage settlement entered into a settlement under Section 12(3) of the Industrial Disputes Act, 1947, dated 29.05.2025, which was given retrospective effect from 01.09.2023 respectively. As per the said settlement, the petitioners are entitled to the difference in leave salary and gratuity. However, the said benefits have not been extended to the petitioners. Though the petitioners submitted their representations dated 21.03.2026, 26.03.2026, 13.04.2026 and 16.04.2026 in this regard to the respondents, the same have not been considered. Hence, the petitioners have come up with these Writ Petitions.

3. The learned Standing Counsel for the respondents would fairly submit that they are willing to pay the applicable differential amount of Salary, and Gratuity in accordance with the 15th Wage Settlement dated 29.05.2025, together with interest at the rate of 6% per annum from the date of their

retirement till the date of payment within a period of six weeks from the date of receipt of a copy of this order.

4. Heard the learned counsel appearing for the petitioners and the learned standing counsel appearing for the respondent corporation.

In view of the above submission of the learned Standing Counsel appearing on behalf of respondent, this Court deems it appropriate to direct the respondents to pay the applicable differential amount of Salary and gratuity to the petitioners, in accordance with the 15th Wage Settlement dated 29.05.2025, together with interest at the rate of 6% per annum from the date of their entitlement till the date of payment , within a period of six weeks from the date of receipt of a copy of this order.
