Pursuant to the order passed by this Court in Crl.R.C.Nos.1341 and 1342 of 2024 dated 14.08.2024, the petitioner handed over a sum of Rs.15,00,000/- by way of two Demand Drafts vide DD.Nos.423910 and 423911 dated 03.09.2024 to the respondent. The respondent/complainant also acknowledged the receipt of Demand Drafts and a copy of the Demand Draft along with a memo filed.
2.In view of the same, this Court is inclined to suspend the sentence imposed on the petitioner. Accordingly, the Substantive Sentence of Imprisonment imposed on the petitioner is suspended till the disposal of the revisions and he is ordered to be enlarged on bail, on condition that he shall execute a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two common sureties, each for a like sum to the satisfaction of the trial Court.
3.Further, the petitioner shall appear before the Trial Court on the Page No.1/4
first working day of every month at 10.30 a.m. until the disposal of the criminal revisions and if he is not able to appear before the Trial Court on that day, he shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the Trial Court on any other day in lieu of the date of her absence as directed by the Trial Court. Accordingly, these Miscellaneous Petitions are ordered.
4.It is submitted that during the pendency of the appeal, the petitioner already paid Rs.15,00,000/- and so far, the petitioner paid Rs.30,00,000/-. Further, it is agreed that the petitioner can pay the balance amount of Rs.15,00,000/- in instalments.
5.The learned counsel for the petitioner agreed to pay the balance amount of Rs.15,00,000/- by way of three installments, in any event, on or before 28.10.2024.
