A.No.3854 of 2023 in C.S(Comm.Div).No.251 of 2022 P.T.ASHA, J., This petition is filed by the applicant / plaintiffs seeking permission to effect substituted service in any daily newspaper, having circulation in the District of Mumbai in respect of the 2nd defendant.

2. Heard the learned counsel for the applicants/plaintiffs and the learned counsel for the third defendant.

3. Since the petitioners are unable to serve the 2nd defendant despite taking steps, this application is ordered and this Court permits the petitioners to take substituted service by publication in any newspaper having circulation in the District of Mumbai, for the hearing date on 15.09.2023. The publication shall be effected ten days prior to the date of hearing.

4. Post the matter on 15.09.2023.
