This Criminal Original Petition has been filed by the petitioner/A1, who was arrested and remanded to judicial custody on 18.06.2024, seeking bail in Crime No.117 of 2024 registered under 174 Cr.P.C and later altered under Section 306 of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated in this case. He further submitted that the petitioner is the mother of the victim/deceased and due to the family dispute, a false complaint has been given against the petitioner. He also submitted that the petitioner has not abetted the victim to commit suicide and she has been suffering incarceration from 18.06.2024. Hence, he prayed for bail.

Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner/A1, who is the mother of the victim/deceased, after the death of her husband, was having an affair with the third person, due to which, the victim became depressed and started living at the house of her grandfather/ de facto complainant. Therefore, the accused had compelled her to come with her, during which, the accused had abused and attacked the de facto complainant and his wife. Due to the frustration caused by the accused, the victim/deceased has committed suicide by hanging and she has also left the suicide note.

4. He further submitted that the case is under investigation. Therefore, if the petitioner is released on bail, there is a possibility of her absconding and not available for further investigation. Hence, he opposed to grant bail to the petitioner.

Taking into consideration facts and the submissions made by the learned Government Advocate (Criminal Side) that the investigation is not yet completed and also considering the nature and gravity of the offence committed by the accused, this Court is not inclined to grant bail to the petitioner.
