.. Respondent/Respondent The petitioner has challenged the impugned award on the ground of unilateral appointment of Arbitrator by the respondent. The petitioner also contends that equal opportunity was not granted to him in the arbitral proceedings to contest the case on merits. The petitioner also contends that within a period of one month from the date when the claim statement was filed by the respondent, the impugned award has been passed, which amounts to patent illegality.
2. The learned counsel for the petitioner is ready today. However, the learned counsel for the respondent submits that he has not been served with entire copies of papers pertaining to this petition. The 1/3
learned counsel for the petitioner submits that copies of papers were sent through a registered post to the respondent with acknowledgment due. Since the learned counsel for the respondent submits that he has not been served with copies of papers pertaining to this case, the petitioner's counsel is directed to serve papers once again on the respondent's counsel before the next hearing date.
3. The petitioner is having the benefit of interim stay from 26.07.2024. The said interim stay is made absolute and accordingly, A.No.3785 of 2024 is allowed as prayed for.
Post the matter for arguments on 26.02.2025.
