ORDER

The petitioners, who were arrested and remanded to judicial custody on 26.05.2026 for the alleged offences under Sections 296(b), 115(2), 324(4), 329(3), 351(3) of BNS r/w 4 of TNPWH Act in Crime No.117 of 2026 on the

file of the respondent police, seek bail.

2. The case of the prosecution is that the Petitioners/ accused consumed alcohol and trespassed into the house of de facto complainant and tried to molest the women in the house and also abused them with the filthy language. Hence, the case.

3. The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in the present case and that they have not committed any offence as alleged by the prosecution. He further submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioners.

4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that totally there are three accused and that under the influence of cannabi, the petitioners entered into the de facto complainant's residence and misbehaved with the woman residing there. Hence, he opposed the grant of bail to the Petitioners.

5. I have given my anxious consideration to either side submissions and perused the materials available on record.

6. Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); it is observed that there are serious allegations against the petitioners. This Court is of the firm view that it is not an appropriate stage to enlarge the petitioners on bail. Furthermore, as the other accused is absconding, releasing the petitioners on bail would jeopardize the prosecution case.

7. Accordingly, this Criminal Original Petition stands dismissed. 25-06-2026 SHL To:
