This petition has been filed by the petitioner to refund the extra court fees paid in the above CMA.

2. Heard the learned counsel for the appellant.

3. The learned counsel for the appellant has submitted that the appellant has paid a sum of Rs.10,583/- towards court fee in this CMA. The said CMA was allowed on 21.01.2021 by this Court. As per Section 43 (1) (c ) of CPC, only Rs.200/- has to be paid towards court fee and hence, he seeks to refund of extra court fee paid in this CMA.

4. A perusal of the records also shows that the appellant has paid Rs.10,583/- as court fee in this CMA.

5. In view of the above, the Registry is directed to refund extra court fee paid by the petitioner/appellant after deducting a sum of Rs.200/- to the petitioner.

6. In the result, this petition is allowed.
