(Order of the Court was made by the Hon'ble R.Subramanian J.) Pursuant to the interim order dated 03.04.2024, the respondent has deposited a sum of Rs.40,00,000/- to the credit of the suit. The suit was decreed for a sum of https://www.mhc.tn.gov.in/judis

Rs.70,00,000/- + interest and cost. The value of the appeal is Rs.96,70,959/-. The respondent / petitioner in CMP.No.16623 of 2024 seeks permission to withdraw the amount that was the said sum of Rs.40,00,000/-

2. Considering the defence that was set up in the suit, we find that the petitioner has made a case for grant of permission to withdraw the amount.
