These Criminal Miscellaneous Petitions have been filed seeking to condone the delay of 173 days in filing the above Criminal Revision Case against the order dated 04.10.2024 passed in C.A.Nos. 155 and 156 of 2023, on the file of II Addl. District and Sessions Judge, Tiruchengode.
2. Mr.R.Nalliyappan, learned counsel for petitioner submitted that due to delay in obtaining certified copy of judgment and also due to financial hardship, the petitioner is not able to instruct counsel on record to prefer the above Criminal Revision cases and only during month of June 2025, he gave papers to him, as a result of which, there is a delay of 173 days in filing the above Criminal Revision Cases arose, which is neither willful nor wanton. Therefore, he filed these petitions to condone the delay in filing the above Criminal Revision Cases.
3. Despite service of notice and despite his name was printed in the cause list, none appeared on behalf of respondent.
4. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow these petitions.
