PRAYER:
Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the first respondent to consider the representation of the petitioner dated 24.07.2023 in accordance with law, by providing adequate Police protection at the cost of the petitioner to perform the Temple Festival of Sri Annamar Temple from 07.08.2023 and 08.08.2023 Adi Thiruvila situated at Vellalagundam Village, Valapady Taluk, Salem District to secure the ends of justice.

ORDER
This writ petition has been filed to direct the respondent-police to provide police protection based on the representation made by the petitioner on 24.07.2023.
2. Heard the learned counsel for the petitioner and the respondent and also perused the materials available on record.
3. It is seen from the record that the very same petitioner had filed a petition in WP.No.18910 of 2022 earlier and this Court, after considering the Page No.2/5
facts and the circumstances of the case, had dismissed that petition by order dated 25.07.2022.
4. The learned Additional Public Prosecutor, on instruction submitted that the same position is prevailing even now and hence the respondent-police are not inclined to give any permission to conduct the temple festival.
5. In the considered view of this Court, there is no question of involving the police in the temple festival dispute. If the concerned persons are not able to conduct the temple festival in a peaceful manner, it is not necessary for conducting such a temple festival. If any law and order problem is created during the festival, the respondent police shall immediately interfere and take action against the concerned persons. If it goes out of the control, the temple festival itself can be stopped.
