ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 5(n), 5(l) and 6 of Protection of Child from Sexual Offence Act, 2012 in Crime No.33 of 2025, on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner and the defacto complainant's daughter had love affair and pursuant to the love affair, the petitioner had sexual intercourse with the victim girl, as a result. the victim girl became pregnant and aborted. Hence, the case. 3.Learned counsel for the petitioner submits that the petitioner has nothing to do with the alleged offence and he has been falsely implicated in this case.
4. The learned Government Advocate (Crl.Side) appearing for the respondent would submit that he petitioner who is aged 27 years had committed penetrative sexual assault on the minor girl who is aged 15 years at her home in the absence of her parents. He would further submit that the statement of the victim girl has been recorded under Section 164 of Cr.P.C.
wherein she has categorically stated the manner in which the accused had committed the crime. Hence, he vehemently opposed for the grant of bail to the petitioner.
5.Taking into consideration the gravity of the offence and the victim girl is only 15 years old and the petitioner had sexually assaulted her, this Court is not inclined to grant bail to the petitioner and hence, this petition stands dismissed.
