This Criminal Miscellaneous petition has been filed seeking to relax the condition that the petitioner/1st Accused shall appear before the learned Judicial Magistrate No.1, Namakkal on the first working day of every English Calendar month at 10.30 a.m., until further orders imposed by this Court vide order dated 17.10.2023 passed in Crl.M.P.No.15673 of 2023 in Crl.R.C.No.1658 of 2023.

2. Learned counsel for the petitioner submitted that, inspite of his ill-health, the petitioner has been complying with the condition imposed by this court regularly. However, in view of the fact that he was aged about 72 years with health ailments, the petitioner is finding it difficult to continue to comply with the said condition imposed by this court.

3. In view of the above submission made by the learned counsel for the petitioner, the condition insofar as appearance as imposed by order dated 17.10.2023 alone stands modified and the petitioner shall appear before the trial court once in six month, till the disposal of the revision. All other conditions remain unaltered.

4. Accordingly, this Criminal Miscellaneous petitions stands ordered.

5. List the main Criminal Revision Case in Crl.R.C.No.1658 of 2023 as per seriatum.
