Prayer: Criminal Original Petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to order and extend the time to execute bond for Rs.10,000/- with two sureties each for a like sum to the satisfaction XXXVI Metropolitan Magistrate, Egmore, Chennai - 600 008 vide order dated 02.07.2024 in Crl.M.P.No.17904 of 2024 in Crl.A.No.466 of 2024 XVIII Additional Sessions Court, Chennai.

O R D E R

This Criminal Original Petition is filed for extension of time to surrender for getting suspension of sentence. The order of the Lower Appellate Court had imposed two conditions.

(i). The petitioner shall deposit 20% of the compensation amount to the credit of S.T.C number on the file of the Trial Court within 60 days from the date of order and (ii). The petitioner is ordered to be enlarge on bail on his execution of a bond for Rs.10,000/- with two sureties each for a like sum to the satisfaction of the Learned XXVI Metropolitan Magistrate, Egmore, Chennai on or before 09.07.2024.

2. So far, the petitioner has not complied these orders. As far as time to surrender got expired and regarding other condition to deposit of 20% compensation amount, he needs some more time. Hence, seeks extension of time to surrender.

This Court, to ensure his bonafide and compliance directs the petitioner herein to deposit 10% of the compensation amount on or before 07.08.2024 and on such deposit, time for surrender been extended. The balance 10% to be paid before expiry of 60 days as per the direction of the Lower Appellate Court. If the petitioner surrender after depositing 10% of the compensation amount, his application for extension of time to be considered on the same day.

4. With this observation, this Criminal Original Petition is disposed of.
