C.M.P.No.15378 of 2022 in S.A.No.2040 of 2004 KRISHNAN RAMASAMY, J., This petition has been filed by the petitioners/L.R's of the appellant to condone the delay of 1159 days in filing the petition to set aside the order dated 05.03.2019 passed by this Court in dismissing the above appeal in S.A.No.2040 of 2004 for nonprosecution and restore the same. 2.Though notice served on the respondent and the name is printed in the cause list, none appeared on behalf of the respondent.

3.Having been satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is allowed.
