The petitioner, who apprehends arrest for the alleged offence under Sections 465, 467, 471, 406, 420 IPC in Crime No.38 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. There are four accused and others in this case, in which the petitioner is arrayed as A5. The case of the prosecution is that the petitioner along with A1 received a sum of Rs.2,47,20,000/- from 98 victims for getting allotments in the Tamil Nadu Housing Board. It is alleged that the petitioner has received commission for the same. Hence, the case.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution. He would further submit that A1 was arrested and released on bail. Hence, he prays to grant anticipatory bail to the petitioner. 4.The learned Additional Public Prosecutor appearing for the

respondent submitted that the petitioner along with A1 received a sum of Rs.2,47,20,000/- from 98 victims for getting allotments in the Tamil Nadu Housing Board. The specific overt act as against the petitioner is that he received commission for the same. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5.Considering the fact that the petitioner along with other accused persons collected a sum of Rs.2,47,20,000/- from 98 victims for getting allotments in the Tamil Nadu Housing Board. Insofar as the petitioner is concerned, he introduced the victims to other accused persons and received commission. As such, the custodial interrogation of the petitioner is very much required. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
