O R D E R

The petitioner challenges the order dated 4.9.2012 in Notification No.16 MRB on the file of Medical Services Recruitment Board.

2. The name of the petitioner was sponsored by the Employment Exchange for appointment to the post of Radiographer. The petitioner appeared for certificate verification on 25.6.2012. Nothing was heard thereafter. The petitioner wanted the respondent to appoint him pursuant to the Notification dated 4.9.2012.

3. The respondent filed a counter affidavit, wherein it was contended that earlier selection was cancelled by this Court vide order dated 16.10.2012 in W.P.No.15302 of 2012. This Court directed the Employment Exchange to forward a fresh list of candidates. https://hcservices.ecourts.gov.in/hcservices/

According to the respondent, fresh list does not contain the name of the petitioner and as such he was not appointed.

4. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing on behalf of the respondent.

5. There is no dispute that initially the name of the petitioner was sponsored by the Employment Exchange for appointment to the post of Radiographer. This Court set aside the selection and directed the respondent to call for a fresh list from Employment Exchange. It is a matter of record that the subsequent list sent by the Employment Exchange does not contain the name of the petitioner. The respondent is therefore correct in his contention that it is not possible to appoint the petitioner on account of absence of his name in the list sent by the Employment Exchange. I am therefore of the view that there is no merit in the contention raised by the petitioner.
