This Criminal Original Petition has been filed by the petitioner/A12, who was arrested and remanded to judicial custody on 23.10.2023, seeking bail in S.C.No.238 of 2023 pending trial on the file of the IIIrd Additional District and Sessions Judge, Cuddalore at Vridhachalam, in connection with Crime No.135 of 2018 registered for the offence under Sections 120(B), 147, 148, 294(b), 302 of IPC and Section 3 of the Tamil Nadu Public Property (Prevention of Damage and Loss) Act.
2. Learned counsel appearing for the petitioner submitted that this is the third application for bail filed by the the petitioner before this Court. He further submitted that the petitioner has nothing to do with the alleged offence and he has been suffering incarceration from 23.10.2023. Hence, he prayed for bail stating that, the petitioner is ready to abide by any stringent conditions that may be imposed by this Court.
3. Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection stating that, it is a case where, the petitioner/A12 along with other accused kidnapped the victim/deceased and murdered him. He further submitted that the case was taken up for trial in S.C.No.238 of 2023 pending trial on the file of the IIIrd Additional District and Sessions Judge, Cuddalore at Vridhachalam, and his earlier bail applications in Crl.O.P.Nos.11638 & 15018 of 2024 were dismissed by this Court vide orders dated 05.06.2024 & 03.07.2024 respectively and there is no change in circumstances. https://www.mhc.tn.gov.in/judis

Taking into consideration the facts and circumstances of the case and the submission made by the learned Government Advocate (Criminal Side) that there is no change in circumstances and also considering that the trial has been commenced, this Court is not inclined to grant bail to the petitioner.
