This Criminal Original Petition has been filed by the petitioner/A7, who was arrested and remanded to judicial custody on 12.09.2023, seeking bail in S.C.No.51 of 2024 pending trial on the file of the IV Additional District and Sessions Judge, Ponneri, in connection with Crime No.896 of 2023 registered for the offence under Sections 120(B), 147, 148, 341, 302 of IPC (3 counts) 450, r/w 149 of IPC.

2. Learned counsel appearing for the petitioner submitted that this is the second application for bail filed by the the petitioner before this Court. He further submitted that the petitioner has nothing to do with the alleged offence and he has been suffering incarceration from 12.09.2023, even after completion of investigation. He also submitted that the coaccused in this case has been granted bail by this Court and the petitioner is also ready to abide by any stringent conditions that may be imposed by this Court, hence, he sought for bail.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection stating that, it is a case of double murder and there are eight accused in this case and the petitioner is arrayed as A7. He further submitted that the case was taken up for trial in S.C.No.51 of 2024 pending trial on the file of the IV Additional District and Sessions Judge, Ponneri, and the earlier bail application in Crl.O.P.No.16369 of 2024 filed by the petitioner was dismissed on 11.07.2024 with a direction to the trial Judge to dispose the case within six months from the date of receipt of a copy of that order, but, the petitioner has filed the present petition within 20 days from the date of dismissal of the earlier bail petition. https://www.mhc.tn.gov.in/judis

4. It is seen that the petitioner has filed the present petition despite the order issued by this court in his earlier bail petitioner on 05.07.2024. Therefore, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Original Petition stands dismissed. The learned trial Judge is directed to strictly comply with the order passed by this Court in Crl.O.P.No.16369 of 2024 dated 11.07.2024.
