This criminal original petition has been filed for a direction to the 1st respondent to alter the Section in crime No.66/2024 by including the offence under Section 306 IPC.

2. The petitioner is the complainant in crime No.66/2024 registered under Section 174 Cr.P.C. The case of the petitioner is that her husband borrowed loan from IDFC Bank and committed default; due to the torture given by the banker insisting repayment of loan amount, the petitioner's husband suffered severe mental agony and committed suicide with a suicidal note; the suicidal note states that unable to bear the hard-hearted approach of the bank officials, the petitioner's husband decided to commit suicide.

3. It is seen that investigation is pending on the file of the 1st respondent. While so, the petitioner is insisting to include Section 306 IPC as against the bank officials. Therefore, in view of the above, the 1st respondent is directed to alter the offence, if any relevant material is available as against the bank officials to attract the offence under Section 306 IPC during the course of 2/4

investigation and alter the offence accordingly and file a final report within a period of 12 weeks from the date of receipt of a copy of this order.
