The petitioner, who was arrested and remanded to judicial custody on 22.11.2021, for the alleged offence under Sections 8(c) r/w 20(b) (ii) ( c ), 28,29 of NDPS Act,1985 in NCB-F No.48/1/13/2021-NCB/MDS) on the file of the respondent seek bail.

2. Totally there are six accused in this case and the petitioner herein arrayed as A-3. The case of the prosecution is that the petitioner was in possession of 212.500 kgs of ganja Hence the complaint.

3. The learned counsel for the petitioner would contend that the petitioner is an innocent and a false case has been foisted against him. He would further submit that the petitioner is no way connected with the said occurrence.

4.The learned Government Advocate (Crl.Side) appearing for the respondent police would contend that the quantity involved in this case is commercial quantity. He further submitted that investigation is completed and charge sheet is been filed and the case is taken on file. Hence, he opposed to grant bail to the petitioner. 1/3

5.Heard both side and perused the materials available on record. 6.Considering the nature of offence and the quantity involved in this case is commercial in nature, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed. It is seen from records that the case is pending from the year 2022, hence, there shall be a direction to the concerned Judge to complete the case within a period of six months from the date of receipt of the copy of this order.
