The petitioner/sole accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 417 and 420 of IPC in Crime No.6 of 2023, seeks anticipatory bail.
2. The case of the prosecution is that it is a case of love affair and the defacto complainant got pregnant and later aborted and the petitioner married another women. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner never married the defacto complainant and that the petitioner is an innocent person and he has been falsely implicated in this case. Therefore, he prays for grant of bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for the respondent Police on instructions stated that the defacto complainant lodged complaint to the Inspector of Police, All Women Police Station, Vadapalani Chennai and a case in Cr.No.6 of 2023 for the alleged offence under Sections 1/3
417 and 420 of IPC was registered as against the petitioner herein. According to the investigation, the defacto complainant was made pregnant by the petitioner and during the process of abortion, he has signed in the papers submitted to the hospital and hence it is matter for investigation. Therefore, he vehemently opposed for grant of anticipatory bail to the petitioner. 5.Heard the learned Counsel for the petitioner and the learned Government Advocate (Crl.side) and perused the materials available on record.
6. After hearing the learned Government Advocate (Crl. Side) and taking into consideration the nature and gravity of the offence and that the petitioner herein has signed in the papers submitted to the hospital and that the matter is under investigation, this Court is not inclined to grant bail to the petitioner.
7.Accordingly, this Criminal Original Petition is dismissed. 11.08.2023 ars 2/3
