PRAYER To direct the respondents to consider the petitioner's representation dated 26.05.2025 in respect of retrospective promotion in the post of Forester on par with the petitioners juniors from 16.08.2017 as per the panel for the post of Forester for the year 2016-17 (Crucial Date 15.08.2016 ), promotions made in the proceedings No.AB1/16264/2017, dated 16.8.2017 and to fix the Inter-SeSeniority by adopting the Rota Quota Rule mentioned in the Rule 5 of the Tamilnadu Forest Subordinate Service Rules and revise the Annual list of Foresters corrected as on 1 st January 2024 with all consequential service and monetary benefits on par with Juniors within time frame. ORDER
The instant writ petition has been filed to direct the respondents to consider the petitioner's representation dated 26.05.2025 in respect of retrospective promotion in the post of Forester on par with the petitioners juniors from 16.08.2017 as per the panel for the post of Forester for the year 2016-17 (Crucial Date 15.08.2016), promotions made in the proceedings No.AB1/16264/2017, dated 16.8.2017 and to fix the Inter-Se-Seniority by adopting the Rota Quota Rule mentioned in the Rule 5 of the Tamil Nadu Forest Subordinate Service Rules and revise the Annual list of Foresters corrected as on 1 st January 2024 with all consequential service and monetary benefits on par with Juniors within time frame.

The petitioners, initially appointed as Forest Guards with Driving License in 2007, and would contend that they were not promoted to the post of Forester in 2017 despite completing over 10 years of service. But the petitioners were promoted belatedly only in 2020. Meanwhile, their juniors from the Tamil Nadu Ministerial Service and Assistant Draughtsman were promoted as Foresters in 2017. The petitioners argue that the respondents failed to follow the Rota Quota Rule under the Tamil Nadu Forest Subordinate Service Rules.
3. Learned counsel for the petitioner would submit that he has sent a representation on 26.05.2025 seeking retrospective promotion and such representation is pending with the respondents.
4. Learned Additional Government Pleader appearing for the respondents would submit that the petitioner is seeking promotion with effect from 2016, however, the same is hit by laches and delay. He would further fairly submit that the respondents will consider the petitioner's representation on its own merits.
5. In view of the submission, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 26.05.2025 and pass orders on its own merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.
