(Order of the Court was made by N.Kirubakaran, J) As per the instruction received from the Registry only the Court fee to a sum of Rs.2,07,465/- has been paid by the learned counsel for the petitioner as the Registry insisted that only O.S.A. is maintainable and appropriate court fee should be paid.
However, on verification, it is found that only an application is maintainable to set aside the decree and judgment passed by the learned Master before the learned single Judge and a fixed Court fee of Rs.50/- has to be paid. In this regard, an endorsement has been made by the Assistant Registrar (A.E.). Therefore, the excess court fee already paid by the petitioner shall be refunded to the petitioner. The registry is directed to collect Rs.50/- as fixed fee for filing an application by the petitioner.
