ORDER

The petitioner, who was arrested and remanded to judicial custody on 08.02.2025 for the offences punishable under Sections 332(b), 118(2), 109(1) & 103(1) of BNS, 2023 altered to Sections 103(1), 109(1), 118(2), 296(b), 332(a) & 3(5) of BNS, 2023 in Crime No.55 of 2025, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner along with other accused trespassed into the de-facto complainant's sister's house and assaulted the de-facto complainant's siter and her husband using iron rod, thereby the de-facto complainant's sister sustained severe head injury and died on the spot and her husband was lying with his throat slit and he was sent to Government Hospital in 108 Ambulance. Hence, the case.

3. The learned counsel for the petitioner submitted that the husband of the deceased had sought for some sexual favour with the petitioner's 2/6

mother. Got enraged over the same, the petitioner questioned the husband of the deceased and there was a wordy quarrel and exchange of words, at that time, the deceased intervened and sustained injuries and later died. The petitioner had no motive to attack the deceased. Hence, prayed for granting bail to the petitioner.

4.The learned Government Advocate strongly opposed for granting bail to the petitioner stating that there was a dispute between the deceased and petitioner's mother with regard to property. The petitioner's mother demanded the share of deceased in favour of her, which was resisted by the deceased family. The petitioner along with A2 armed with iron road went to the house of the deceased and picked up a quarrel, assaulted the deceased mercilessly and done to death. Her husband intervened and he had also sustained serious injuries. There are eyewitnesses to the occurrence. Further, in this case A2 is the juvenile. The case against him proceeds separately. Now investigation completed, charge sheet filed and the same has been committed 3/6

before the learned Judicial Magistrate No.II, Thirupathur. He further submitted that against the petitioner yet another murder case in S.C.No.180 of 2022 is pending in Hosur Court. The petitioner planned and murdered the deceased. In this case, there is a possibility of retaliation, since the husband of the deceased is the Panchayat President of the village and the relatives and friends are all enraged against the act of the petitioner. 5.Considering the seriousness of the offence, this Court is not inclined to grant bail to the petitioner and hence, the criminal original petition is dismissed.
