ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 147, 323, 387 and 506(i) of IPC, in Crime No.885 of 2021 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner snatched the cell phone of the defacto complainant. Thereby demanded gold jewels. Based on the complainant lodged by the defacto complainant, the Law Enforcing Agency registered a case against the petitioner. 3.The learned counsel appearing for the petitioner submits that the petitioner has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) submits that one previous case similar in nature pending against the petitioner. He further submits that the stolen property has not been recovered. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.
5. Considering the allegation level against the petitioner and also considering that the stolen property has not been recovered, this Court is not inclined to grant anticipatory bail to the petitioner.
