O R D E R
Aggrieved over the order passed by the learned Chief Judicial Magistrate, Puducherry, returning the petition filed under Section 175 (3) of BNSS Act, the present petition is filed.
2. Heard the learned counsel for the petitioner and the learned Public Prosecutor (Pondicherry) appearing for the respondents and perused the documents placed on record carefully.
3. The petitioner filed an application under Section 175 of BNSS, 2023 seeking investigation by the police. It is alleged by the petitioner that the accused had colluded together and committed forgery by making false entry in the revenue records, thereby sought for investigation. It is relevant to note that the offences are not relating to any Prevention of Corruption Act and it is only with regard to the alleged forgery and falsification of records.
4. In such view of the matter, the trial court shall decide whether it Page No.2 of 4
is a fit case for investigation by the Investigation Officer and thereafter, pass an order. Accordingly, the impugned Docket order in Crl.M.P.No.1314 of 2025 dated 24.03.2025 is set aside. The learned Chief Judicial Magistrate, Puducherry is directed to take a decision whether this complaint is worth referring to the investigation as per law.
