ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 373 and 379 of IPC in Crime No.115 of 2009 on the file of the respondent police, seeks anticipatory bail.

2. Heard both sides.

3.It is seen from the submissions made by the learned counsel for the petitioner and the learned Government Advocate that this case is pending in PRC.No.97 of 2010 on the file of XV Metropolitan Magistrate, George Town, Chennai. The offences alleged against the petitioner in this case are under Sections 373 and 379 of IPC.

4. It is submitted by the learned Government Advocate that the petitioner had been evading the summons and ultimately Non-Bailable Warrant was ordered against him. The case was registered in the year 2009. 2/5

5. Considering the facts and circumstances of this and this case is pending in the preliminary enquiry stage because of the non-appearance of the accused, I am inclined to issue the following directions.

6. This Court directs the petitioner to surrender and seek bail before the learned Principal Judge, City Civil Court, Chennai within a period of 15 days from the date of receipt of copy of this order and the learned Principal Judge, City Civil Court, Chennai is directed to dispose the bail application on the same day on merits.

7. With the above direction, this Criminal Original Petition is disposed of.
