ORDER

(Order of the Court was made by S.M.Subramaniam J.) Learned counsel for the Applicant would submit that there is a Supreme Court order in their favour, which has not been considered by this Court, while deciding the intra Court appeal.

2. Re-adjudication of merits in a review proceedings is impermissible. The scope of Review Application cannot be extended for the purpose of adjudication of grounds on merits.

3. Learned counsel for the Applicant would rely on Paragraph No.10 of the judgment and state that the judgment, in the case of Shambu Sharan Singh vs. CMD, UCO Bank and Others, relied on by this Court is incorrect. Such a ground taken would not constitute an error apparent, warranting exercise of powers of review. The merit of the case has been duly considered by this Court elaborately in respect of other grounds raised by the parties.
