2) that two sureties should produce their bank pass book iii) that one of the surety should deposit their property documents in Crl MP No.6886 of 2019 dated 23.07.2019.

O R D E R

This petition has been filed challenging the condition imposed by the Court below while granting bail to the petitioners.

2. The petitioners were arrested and remanded to judicial custody on 20.06.2019 for an offence under Section 380 IPC. The allegation against the petitioners is that they had committed theft of silk sarees to the tune of Rs.2,00,000/-. The commission of the crime was also recorded in the CCTV camera. 3.

The petitioners filed a bail petition before the Court below. The Court below after taking into consideration the gravity of the offense and the fact that the petitioners belong to a different state, imposed several conditions against the https://hcservices.ecourts.gov.in/hcservices/

petitioners while granting bail. The petitioners are aggrieved by conditions 2, 4 & 6.

4. Heard the learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of respondent.

Taking into consideration the facts and circumstances of the case, the 2nd condition imposed by the Court below is modified to the effect that all the petitioners put together, shall deposit a sum of Rs.50,000/- in Crime No.163 of 2019.

6. Insofar as the 4th condition is concerned, it will be enough if the sureties produce the Aadhar card as proof and it is not necessary for them to produce Bank Pass Book.

7. Condition No.6 is an onerous condition and accordingly, the same is set aside. The other conditions imposed by the Court below shall stand as it is.

8. This Criminal Original petition is disposed of accordingly.
