Respondent Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent herein to consider their representation dated 25.07.2019 given to the respondent for considering their candidature in the MOP-UP counseling for the MBBS course for the academic year 2019-2020, within a time frame to be fixed by the Court.

O R D E R

The petitioners appeared in NEET examination for the year 2018 and they were admitted in the Pondicherry Institute of Medical Science. Since their names were not sponsored by CENTAC the Medical Council of India cancelled their admission. The petitioners herein gave a representation dated 25.07.2019 to the respondents to permit them to participate in the mop-up counseling for the academic year 2019-2020.

2. In the counter, the respondent has stated that the petitioners being qualified in the NEET examination for the year https://hcservices.ecourts.gov.in/hcservices/

2018 and having registered their names in CENTAC, they may participate in the 2019-2020 mop-up counseling, if there is any vacancy. In such case, the petitioners will be considered along with the other eligible candidates on merits. The respondent also states that the petitioners have been already informed about their entitlement to participate in the CENTAC and compete with other eligible candidates on merits.

3. Recording the same, the writ petition is disposed of with a direction to the respondent to consider the petitioners' candidatures in the mop-up counseling, as per the merit. No costs. Consequently, connected Miscellaneous Petitions are closed.
