Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned order passed by the respondent dated 20-072016, to quash the same and consequently direct to respondent to grant permission to the petitioner to conduct the dance programme which is scheduled to be held on 11-08-2016 at Periya Pavadi Sengunthar Kalaiarangam near Mariamman Temple, situate at Vennanthur Village, Rasipuram Taluk, Namakkal District. By consent, the writ petition is taken up for final disposal. 2.The petitioner claims to be the Organizer of the Temple festival relating to Arulmigu Sri Mariamman Temple, situate at Vennanthur Village, Rasipuram Taluk, Namakkal District and he submitted an application dated 20.07.2016 to the respondent praying to grant permission to conduct cultural programme which include, song and dance programme in connection with the said Temple festival and it was rejected by the respondent vide impugned order dated 20.07.2016 and challenging the legality of the same, has come forward to file this writ petition.

3.The learned counsel appearing for the petitioner would submit that the application submitted by the petitioner has been rejected by the respondent through the impugned order, without assigning any reason and prays for interference.

4.Per contra, Mr.A.N.Thambidurai, learned Special Government Pleader who accepts notice on behalf of the respondent would submit that apprehending law and order problem and performance of obscene song and dance only, the permission sought for by the petitioner came to be rejected.

5.However, this Court is of the view that no such reason has been assigned and hence, on the sole ground, the impugned order warrants interference.

6.In the result, the writ petition is partly allowed and the impugned order dated 20.07.2016, is set aside and the matter is once again remanded back to the respondent for fresh consideration and he shall pass orders, as expeditiously as possible and within a period of one week from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
