Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus to direct the respondents 4 and 5 to consider the claim of the petitioner in her representation dated 17.07.2014 and 01.06.2015 for appointment of her son, Thiru.S.Gunasekaran on compassionate grounds, consequent on the death of Thiru.T.Sengodan, 22.08.2012 while in service as Assistant in S.No.1216, Subramaniya Nagar Urban Co.op Bank Ltd, Sooramangalam, Salem-5 in the light of letter Na.Ka.No.4770/2015 dated 03.06.2015 of the third respondent. By consent, the writ petition is taken up for final disposal at the admission stage itself.
2. According to the petitioner her husband T.Sengodan was working as Assistant in Subramaniya Nagar Urban Bank Ltd., Suramangalam, Salem died in harness on 23.08.2012 leaving behind the petitioner, son and daughter as his legal heirs. The petitioner made application seeking for compassionate appointment for her son Gunasekaran. As there was no response, again, she made a representation to the third respondent/Joint Registrar of Cooperative Societies, Salem Region and the fourth respondent/Deputy Registrar of Cooperative Societies, Salem Circle, Salem on 01.06.2015. Since, no order has been passed, the petitioner filed the present writ petition.
3. Heard the submission of Mr.G.Punniyakotti, learned counsel appearing for the petitioner and Mr.L.P.Shanmugasundaram, learned Special Government Pleader, who accepts notice on behalf of the respondents.
4. This Court, considering the submission of the learned counsel for the petitioner, without going into the merits of the case, directs the respondents 5 and 6 to consider the representation of the petitioner dated 17.07.2014 and 01.06.2015 and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
