7. KRISHNAPPA .. Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing respondents 1 to 4

namely the District Collector of Krishnagiri, the Sub Collector of Hosur, the Tahsildhar of Hosur and the Revenue Inspector of Bagalur to consider the representation of the petitioners dated 12.06.2023 and to take action against respondents 5 to 7 by removing their encroachment made in the vari adjacent to their lands in S.Nos.43/7 and 43/8, Allur Village and also to remove the materials placed by them in the said vari within a stipulated time. ORDER

(Order of the Court was made by R.MAHADEVAN,J.) The petitioners have filed this writ petition seeking issuance of a writ of mandamus directing respondents 1 to 4 to consider the representation of the petitioners dated 12.06.2023 and to take action against respondents 5 to 7 by removing their encroachment made in the vari adjacent to their lands in S.Nos.43/7 and 43/8, Allur Village and also to remove the materials placed by them in the said vari within a stipulated time.

2. Taking into consideration the fact that a representation was made by the petitioners on 12.6.2023, without going into the merits of the same, we direct the respondent authorities to consider the said representation of the petitioners dated 12.6.2023 and pass orders on merits and in accordance with law, after affording reasonable opportunity to the petitioners and respondents 5 to 7, within a period of eight weeks from the date of receipt of a copy of this order.

3. With the above direction, the writ petition is disposed of. There shall be no order as to costs. W.M.P.No.5541 of 2024 filed by the petitioners to permit them to file a single writ petition is ordered, inasmuch as the petitioners have paid separate sets of court-fee.
