Respondent(s) PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the 3rd respondent to take further action on the 2nd respondent proceeding in Na.Ka.3091/2023/H2 dated 27.09.2023, consequently direct the 3rd respondent to issue Patta document in petitioner favor in respect of Kundumaranapalli village agriculture land survey no.958/2B which in total extent of 50 cents which is again converted and classified as Podugal on the ground they have long possession and enjoyment of the said land with pay necessary tax to him.

ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed praying for a writ of mandamus directing the 3rd respondent to take further action on the 2nd respondent proceedings dated 27.09.2023, and issue patta in favour of petitioner in respect of the property comprised in Survey No.958/2A measuring an extent of 50 cents, which re-classified as "Podugal".

3. It is submitted by the learned counsel for respondents that originally the subject land was classified as "Vaari" and thereafter re-classified as "Podugal". It is further stated that Podugal is a water body and that question of patta does not arise. He would therefore submit that petitioner's request for reclassification of a water body as "Vaari" and issuance of patta cannot be entertained. 2/4

4. Recording the same, writ petition stands closed. It is open to the petitioner to work out remedy if any that may be available to them insofar as classification of the land is concerned, in the manner known to law. No costs. 03.07.2025 Speaking (or) Non Speaking Order Index : Yes/ No mka To:
