to directing the respondent to pay the petitioner all his retirement benefits including Provident Fund, Gratuity, Leave Salary and all other benefits with interest at the rate of 18% per annum within the time frame that may be stipulated by this Honourable Court and to grant him the interest at the rate of 18% per annum for the belated settlement of his eligible benefits from the date of retirement to till the date of settlement by the respondent within the time frame. WP No.27303 of 2016:
to directing the respondent to pay the petitioner all his retirement benefits including Provident Fund, Gratuity, Leave Salary and all other benefits with interest at the rate of 18% per annum within the time frame that may be stipulated by this Honourable Court and to grant him the interest at the rate of 18% per annum for the belated settlement of his eligible benefits from the date of retirement to till the date of settlement by the respondent within the time frame. WP No.27322 of 2016:
to directing the respondents to settle the petitioner's retirement benefits including Gratuity, Commutation Amount, Leave Surrender (Earned Leave), IRT Amount, DA Arrears, Setelemtn Arrears and Employees Welfare Fund etc., with interest at the rate of not less than 18% per annum payable from the date of retirement and consequently directing the respondents to pay interest at the rate of 18% per annum for the belated settlement of retirement benefits to the petitioner payable from the date of retirement i.e., 31.5.2016 to till date of actual payment to the petitioner within the time.

to directing the respondents to disburse the payments relating to Gratuity, Pension Commutation, Un availed Leave Salary, 30 days Leave surrender amount for the year 2014 and 2015, Dearness allowance arrears, 12(3) settlement arrears by calculating D.A. eligible as per newly implemented scheme, with interest at 12% per annum with effect from 01.08.2015.

WP No.27352 of 2016:
to directing the respondents to settle the retirement benefits payable to the petitioner including service Gratuity, Commutation Amount, Leave Salary Revised Pension with arrears and all other attendant retirement benefits with interest at the rate of not less than 12% per annum payable from the date of retirement within the time that may be stipulated by this Honourable Court by considering and passing orders on the representation of the petitioner dated 14.7.2016. WP No.27399 of 2016:
to directing the respondent to settle the entire retirement benefits of the petitioner i.e. Gratuity sum of Rs. 7,33,132/- + Leave Encashment (EL) in the year 2015 Jan a Sum of Rs. 3,12,435/- + medical leave encashment before 1998 a sum of Rs.1,73,575/- + Social Security Scheme sum of Rs. 34,000/- + arrears of amounts as per 12(3) settlement with effect from 01.09.2013 to till the date of retirement i.e. 31.01.2015 and other attendant benefits and enhanced dearness allowances along with 18% interest on delayed payment from 31.01.2015 to till the date of disbursement of the terminal benefits of the petitioner. to directing the respondent to settle the entire retirement benefits of the petitioner i.e. Gratuity sum of Rs. 4,62,323/- + Leave Encashment (EL) sum of Rs. 22,865/- + All Colleges Fund = Rs. 4,500/- + Social security scheme Rs.48,000/- + arrears of amounts as per 12(3) settlement with effect from 01.09.2013 to till the date of retirement i.e. 30.11.2014 and other attendant benefits and enhanced dearness allowances along with 18%
interest on delayed payment from 30.11.2014 to till the date of disbursement of the terminal benefits of the petitioner. WP No.27420 of 2016:

to directing the respondent to settle the entire retirement benefits of the petitioner i.e. Gratuity amount of Rs.4,53,939 + Leave Encashment (EL) sum of Rs.2,05,088 = Rs.6,59,027/- + arrears of amounts as per 12(3) settlement with effect from 01.09.2013 to till the date of retirement i.e. 31.03.2014 and other attendant benefits and enhanced dearness allowances along with 18% interest on delayed payment from 31.03.2014 to till the date of disbursement of the terminal benefits to the petitioner. WP No.27440 of 2016:
to directing the respondent to settle the entire retirement benefits of the petitioner i.e. Gratuity amount of Rs.5,15,971+ Leave Encashment (EL) sum of Rs.51,993 = Totally sum of Rs.5,67,964/- + arrears of amounts as per 12(3) settlement with effect from 01.09.2013 to till the date of retirement i.e. 14.08.2014 and other attendant benefits and enhanced dearness allowances along with 18% interest on delayed payment from 14.08.2014 to till the date of disbursement of the terminal benefits to the petitioner.
WP No.27441 of 2016:
to directing the respondent to settle the entire retirement benefits of the petitioner i.e. Gratuity amount of Rs.5,15,982/- + Leave Encashment (EL) sum of Rs.1,00,224/- = Totally Rs.6,16,206/- + arrears of amounts as per 12(3) settlement with effect from 01.09.2013 to till the date of retirement i.e. 31.05.2014 and other attendant benefits and enhanced dearness allowances along with 18% interest on delayed payment from 31.05.2014 to till the date of disbursement of the terminal benefits to the petitioner.
WP No.27442 of 2016:
to directing the respondent to settle the entire retirement benefits of the petitioner i.e. Gratuity amount of Rs.4,17,462 + Leave Encashment (EL) sum of Rs.1,73,669 = Totally sum of Rs.5,91,131/- + arrears of amounts as per 12(3) settlement with effect from 01.09.2013 to till the date of retirement i.e. 31.03.2014 and other attendant benefits and enhanced dearness allowances along with 18% interest on delayed payment from 31.03.2014 to till the date of disbursement of the terminal benefits to the petitioner.
WP No.27443 of 2016:
to directing the respondent to settle the entire retirement benefits of the petitioner i.e. Gratuity amount of Rs.5,25,115/- + Leave Encashment (EL) sum of Rs.2,29,856/- = Rs.7,54,971/- + arrears of amounts as per 12(3) settlement with effect from 01.09.2013 to till the date of retirement i.e. 31.08.2014 and other attendant benefits and enhanced dearness allowances along with 18% interest on delayed payment from 31.08.2014 to till the date of disbursement of the terminal benefits to the petitioner. WP No.27445 of 2016:
to directing the respondents to disburse the Provident Fund, Gratuity, Pension Commutation, Leave Encashment (Earned Leave & Old Medical Leave), Surrendered leave wages from 2009 to 2011, Labour Welfare Fund, IRT share amount by calculating D.A. Eligible as per rules, with interest at 12% per annum with effect from 01.03.2016 immediately and award costs. WP No.27446 of 2016:
to directing the respondents to settle the petitioners terminal benefits such as difference in Gratuity, DA arrears, Pension DA arrears and PF arrears with an enhanced dearness allowance at the rate of 58% as per G.O.Ms.No.116, Finance Department dated 09.04.2012 with interest of 18% on delayed payment to the petitioner from 31.08.2011 the date of retirement to till the date of settlement of the terminal benefits to the petitioner by following the order passed in W.A.(MD).Nos.383 to 457 of 2015 dated 12.06.2015.
WP No.27448 of 2016:
to directing the respondent to settle the entire retirement benefits of the petitioner i.e. Gratuity amount of Rs. 5,21,336 + Leave Encashment (EL) Sum of Rs. 1,31,868 + medical leave encashment Rs. 6993/-= Totally sum of Rs. 6,60,197/- + arrears of amounts as per 12(3) settlement with effect from 01.09.2013 to till the date of retirement i.e. 30.06.2014 and other attendant benefits and enhanced dearness allowances along with 18% interest on delayed payment from 01.07.2014 to till the date of disbursement of the terminal benefits to the petitioner. WP No.27449 of 2016:
to directing the respondent to settle the entire retirement benefits of the petitioner i.e. Gratuity amount of Rs. 4,92,219 + Leave Encashment (EL) Sum of Rs. 1,05,612 + 74,400 = Totally sum of Rs. 6,72,231/- + arrears of amounts as per 12(3)

2. The petitioners joined the services of the Transport Corporation and they retired from service long before. The grievance of the petitioners is that though, they retired from service long before, till date, they were not paid with the retirement benefits. In this regard, the petitioners submitted representations before the respondents, on various dates. However, till date, there was no response. Aggrieved against the same, the present Writ Petitions were filed.
3. The learned counsel appearing for the petitioners, brought to the notice of this Court the common judgment, dated 12.06.2015, passed by the Madurai Bench of this Court in W.A. (MD) Nos.383 to 457 of 2015, wherein under similar circumstances, the Transport Corporation undertook to pay the amount due and payable to the petitioners therein in twelve equal monthly instalments. He would further submit that following the same, this Court has passed similar orders in several Writ Petitions. Accordingly, he would pray that a similar order may be passed in these Writ Petitions also.

The learned Standing Counsel, who took notice on behalf of the respondents, would affirm that the issue involved in these Writ Petitions is squarely covered by the judgment passed by the Madurai Bench of this Court in W.A.(MD) Nos.383 to 457 of 2015, dated 12.06.2015 and the relevant portion of the said judgment reads as follows:- "2. The said statement is thus taken on records and the respondents will be bound by the same. We have to keep in mind the judicial pronouncement of the Hon'ble Supreme Court in D.D.Tewari (D)through LRS. Vs. Uttar Haryana Bijli Vitran Nigam Ltd and Others (2014 (9) SCALE -78), wherein it is held that in case of any delay in making the payment of the instalments, the interest payable would become 18% p.a., for the delayed period apart from any other remedy which may be available to the appellants for non-compliance of undertaking given to this Court.
3. The instalments to be paid from July 2015 and each instalments should be paid on or before 7th of each month."

Considering the fact that the issue involved in these Writ Petitions is squarely covered by the orders passed by this Court in similar circumstances, without going into the merits of the matter, the Managing Director and General Manager of the respective Transport Corporation are directed to disburse the aforementioned retiral benefits to the petitioners herein in twelve equal monthly instalments, in the light of the common judgment passed by this Court in W.A.(MD) Nos.383 to 457 of 2015 (K.Rajendran & Others vs. The Tamil Nadu State Transport Corporation (Madurai) Limited, rep. by its Managing Director, Madurai and others), dated 12.06.2015. It is also made clear that the first instalment shall commence from 15.11.2016.
6. With the above direction, these Writ Petitions are disposed of. Consequently, the connected W.M.P.No.23641 of 2016 in W.P.No.27445 of 2016 is closed. No costs.
