This Criminal Original Petition has been filed by the petitioner/A1, who was arrested and remanded to judicial custody on 22.02.2024, seeking bail in Crime No.63 of 2024 registered for the offence under Sections 395, 397, 324 and 506(ii) of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case since he has several previous cases. He further submitted that the petitioner, who is no way connected with the alleged offence, has been suffering incarceration from 22.02.2024. Hence, he prayed to grant bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police objected for granting bail stating that, the petitioner along with four other accused conspired together and robbed 1 sovereign gold chain, a mobile phone and a cash of Rs.6000/- from the de facto complainant at knife point. He further submitted that the investigation in this case has completed, however, since the petitioner is a habitual offender, having several previous cases including the cases registered under Section 302 IPC and also under NDPS Act, if he is released on bail, there is every possibility of him absconding and threaten the witnesses. https://www.mhc.tn.gov.in/judis

Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side and taking note of the gravity of the offence committed by the accused and also considering the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
