The writ petition is filed for issuance of a writ of certiorarified mandamus, to call for the records of the impugned proceeding No.USO.No.20314/A2/2019.
No.03/A2/2019 dated 29.07.2019 issued by the respondent herein and quash the same as null and void as against the basic principle of natural justice and consequently allow the petitioner herein to continue her work in the same place.
2.
The case of the petitioner is that the petitioner was appointed as Assistant Engineer (Civil) Bio-Engineering Section, Madras Veterinary College, Chennai and he joined duty in the year 2018. As she proceeded on maternity leave, she could not complete the regular service of three years in the said place. Whereas without assigning any reason the impugned order of transfer is issued by violating the basic principles of natural justice and the transferred place is far away from Chennai, 1/2
which is more than 450 km and the petitioner having a just born baby, it is difficult to travel to Namakkal and the said order of transfer was passed in the middle of the academic year. 3.
The learned counsel for the petitioner on instructions would submit that time may be granted to the petitioner to join duty in Namakkal and thereafter, permit the petitioner to make a representation for re-transfer to Chennai.
4.
Considering the limited representation made by the learned counsel for the petitioner, I am inclined to extend the time for joining duty to the transferred place by two weeks. Liberty is granted to the petitioner to make representation. If any representation is made, the respondent may pass appropriate orders, in accordance with law. Accordingly, the writ petition is disposed of.
No costs.
Consequently, connected miscellaneous petitions are closed.
