(WP 31767 to 31776/15 WP 15428 to 15432/2014) Mr.N.Inbanathan, GA(F), (Forest Department (in all WPs) C O M M O N O R D E R Claiming to be in possession of the specific extent of lands, in which agricultural operations are being carried out, the petitioners have approached the Tahsildar, by way of representations, for the issuance of pattas. As the said representations are not considered, the present writ petitions have been filed by the petitioners.

2. The learned counsel appearing for the petitioner, in all these writ petitions, submitted that the lands-in-question are neither forest lands nor adjoining them, therefore, there is no bar under law for the Tahsildar concerned to consider the representations of the petitioners, on merits and in accordance with law.

3. The learned Government Advocate appearing for the Forest Department disputed the said submission of the learned counsel for the petitioners and submitted that the lands are forest lands adjoining / abutting them, therefore, in law, the request made by the petitioners cannot be considered.

4. This Court is not inclined to go into the above said factual dispute governing the parties. Admittedly, the issue of consideration of patta is pending consideration before the Tahsildar. Thus, it is suffice to direct the Tahsildar (the fourth respondent herein), to dispose of the pending representations of the petitioners, within a period of eight weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and the officials of the Forest Department. While disposing of the representations, it is open to the Tahsildar to take into consideration the relevant materials including the order, if any, passed by the competent Civil Court in the Civil Miscellaneous Appeals.
