The learned counsel for the appellant made an endorsement indicating that he is withdrawing the intra court appeal with liberty to file an appeal under Section 9(4) of the Tamil Nadu Leaseholds (Abolition and Conversion into Ryotwari) Act, 1963 before the Tribunal.

2. In view of the endorsement so made, the intra court appeal is dismissed as withdrawn with liberty. We make it clear that in case appeal is filed by the appellant before the Tribunal within a period of two weeks from today, the same shall be entertained and disposed of on merits taking into account the pendency of the writ petition and the writ appeal before this Court. No costs. Consequently, connected miscellaneous petition is closed.
