The petition has been filed seeking Succession Certificate in favour of the 1st petitioner, Mrs.Chandra Parthasarathy, with respect to fixed deposit amounts with ICICI Bank, Chitlapakkam Branch and with respect to a current account also with ICICI Bank at Chitlapakkam Branch.

2. The deceased S.Parthasarathy, died on 12.10.2020. He died intestate. The 1st petitioner is his wife. The 2nd and 3rd petitioners are his son and daughter.

3. In view of the fact, that the deceased S.Parthasarathy had left behind aforementioned fixed deposits and the current account, Succession Certificate was required and the petition has been filed seeking Succession Certificate in the name of the 1st petitioner.

4. The 2nd and 3rd petitioners have filed consent affidavit of such grant of Succession Certificate.

5. The 1st petitioner was examined as P.W.1 and during examination Exs.P1 to P14 were marked. Paper publication effected was marked as Ex.P12 and consent affidavit was marked as Exs.P13 and P14. The death certificate of S.Parthasarathy was marked as Ex.P7. The details about the fixed deposits and the current account were marked as Exs.P5, P6 and P9.

6. Heard Mr.N.Meenakshi Sundaram, learned counsel for the petitioners.

7. In view of the said evidence available on record, the Succession Certificate is granted, as sought in the petition.

8. The petition stands allowed. On production of Succession Certificate, since the fixed deposit had been retained by the ICICI Bank, on the amount which had accrued and on the current account, naturally, interest also should be paid to the 1st petitioner. 07.09.2022 ssi O.P.No.6 of 2022 https://www.mhc.tn.gov.in/judis 2/2
