Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents to issue a fresh and corrected birth certificate by rectifying the error made in the existing fresh and corrected birth certificate by rectifying the error made in the existing birth certificate, namely, "REETHIKA" instead of "DIVYA" and mentioned as a Female in the birth certificate to the petitioner's daughter by considering his representation dated 12.06.2025 to comply Section 16 of the Registration of Births and Deaths Act, 1969, within a stipulated period of time fixed by this Court. O R D E R
This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents to deal with the representation made by the petitioner dated 12.06.2025 wherein the petitioner is seeking for rectification of the name of his daughter in the birth certificate and to correct the same as Reethika instead of Divya.
2. Heard Mr.M.Dinesh, learned counsel for the petitioner and Mr.S.Gopinathan, learned Standing Counsel appearing for respondents.
3. The petitioner's daughter was born on 18.03.1998. At the time of issuance of the birth certificate, the name of the daughter was mentioned as Divya. However, the actual name of the petitioner's daughter is Reethika. The same is evident from the Community Certificate, Secondary School Leaving Certificate, Higher Secondary Course Certificate, Provisional Certificate issued by Anna University and also in the passport. Therefore, the correction has to be necessarily carried out in the birth certificate. In view of the above, there shall be a 2/4
direction to the respondents to act upon the representation made by the petitioner and to carry out necessary correction in the birth certificate of the petitioner's daughter and issue fresh birth certificate within a period of four (4) weeks from the date of receipt of a copy of this order. This writ petition is disposed of with the above direction. No costs.
