Respondents PRAYER: This writ petition is filed under Article 226 of Constitution of India, to issue a Writ of Certirarified Mandamus, to call for the records relating to impugned order dated 18.10.2021 passed by the 2nd respondent herein in

Ref.No.58828/CEA/1/2021 and quash the same.

O R D E R

This writ petition has been filed, challenging the impugned order dated 18.10.2021 passed by the 2nd respondent and to quash the same.

2. The case of the petitioner is that the respondents 3 to 5 took treatment from the petitioner's hospital during the covid-19 period and thereafter, they have been discharged from the hospital. On the complaint made by the 3rd respondent as if the petitioner hospital collected huge amount as against G.O.Ms. No.240 dated 05.06.2020, the 2nd respondent passed an order dated 18.10.2021 stating that the petitioner hospital collected excess amount and they are going to take action within 3 days and thereby cancel the Covid-19 treatment permission of the petitioner hospital and also cancellation of the registration of the petitioner hospital. Challenging the same, the present writ petition is filed with the above said prayer.

3. The learned counsel for the petitioner would submit that the 2nd respondent has passed the impugned order without conducting any enquiry. The order was allegedly based only on a complaint from the private respondents, which is a clear violation. Accordingly, he prayed for appropriate directions.

4. The learned counsel appearing for the private respondents would submit that this Court may issue a direction to the 2nd respondent to conduct an enquiry in between the petitioner and the private respondents and pass appropriate orders.

5. In view of the above, there shall be a direction to the 2nd respondent to conduct an enquiry on the basis of the complaint made by the private respondents and the impugned order of the 2nd respondent dated 18.10.2021 and pass appropriate orders within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 22.10.2025 Index : Yes/No : Yes/No Speaking/non-speaking order uma
