Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 1st respondent herein to conduct the enquiry and to dispose of the petitioner's appeal dated 11.08.2021 and consequently, to direct the 1st respondent herein to issue patta to the petitioner in respect of the land comprised in Survey No.35/3, measuring to an extent of about 2.88 Acres at Rettikuppam Village, Karumbakkam Chengalpattu District, within a time frame fixed by this Court.

ORDER

This writ petition has been filed for issuance of a Writ of Mandamus, to direct the 1st respondent herein to conduct the enquiry and to dispose of the petitioner's appeal dated 11.08.2021 and consequently, to direct the 1st respondent herein to issue patta to the petitioner in respect of the land comprised in Survey No.35/3, measuring to an extent of about 2.88 Acres at Rettikuppam Village, Karumbakkam Chengalpattu District, within a time frame.

Taluk, Chengalpattu District was owned by the petitioner's father namely Ramachandran. After his demise, the aforesaid property was inherited by the petitioner, he has been paid all taxes to the Competent Authorities. Subsequently, he made a representation dated 11.01.2020 and 28.07.2020 to the respondent seeking for the issuance of patta, no steps have been taken by the respondent. Meanwhile, he has filed a Writ Petition in W.P.No.10796 of 2020, direction was given to the 2nd respondent to consider the representation of the petitioner dated 28.07.2020 and pass orders within a period of 8 weeks. Till now, the respondent has not passed any order on the petitioner's representation. Thereafter, the petitioner has preferred an appeal to the first respondent on 11.08.2021 requesting him to conduct enquiry and issue patta in his name, but the first respondent did not conduct any enquiry and pass orders on his appeal.

3. Heard both side and perused the records.

4. Having regard to the limited scope of the prayer, this Court is inclined to pass the following order:- The first respondent/RDO is hereby directed to dispose of the appeal dated 11.08.2021 filed by the petitioner within a period of sixteen weeks from the date of receipt of a copy of this order.

5. Accordingly, the Writ Petition is disposed of . No costs.
