This petition filed by the revision petitioner against the order passed by the V Additional Principal Family Court, Chennai, granting an interim maintenance and litigation expenses.

2. The counsel for the respondent submitted that he also challenged the very same order by filing an appeal and the same is in numbering stage. The learned counsel for the respondent submits that both the proceedings are against the very same impugned order.

3. This Court is of the view that the revision petition filed by the petitioner is not maintainable and hence, the same is converted as Civil Miscellaneous Appeal.

The Registry is directed to be assign a new number to the case. The Registry is further directed to post the matter before the appropriate Hon'ble Division Bench after assigning new number.
