O R D E R

The petitioner, who was arrested and remanded to judicial custody on 06.05.2025, for the offences punishable under Sections 296(b), 309(4), 311, 125(b), 324(2) & 351(3) of BNS, in Crime No.130 of 2025, on the file of the respondent, seeks bail.

2. The case of the prosecution is that the accused refused to pay the bill 1/4

in the de facto complainant's shop and when the same was demanded by the de facto complainant, the accused abused him and taken away a sum of Rs.300/- from his shop. Hence the case.

The contention of the learned counsel appearing for the petitioner is that this is the second application for bail filed by the petitioner and that the present case has been foisted against the petitioner only for the purpose of detaining him in custody since he has several previous cases. He further submitted that the petitioner had given a representation dated 24.04.2025 to the Commissioner of Police, Chennai City seeking to transfer his entire history sheeter records to the Chengalpattu Taluk Police Station since he shifted his residence to Ozhalur Village, Chengalpattu stating that he has been blessed with a baby on 28.03.2025 and he is now on the path of reformation. He further submitted that the petitioner will not indulge in any anti-social activities. Hence, he prayed for bail.

Learned Government Advocate (Criminal Side) appearing for the respondent Police reiterated the prosecution case and confirmed that the petitioner was blessed with baby on 28.03.2025 and thereafter, he sent a representation to the Commissioner of Police, Chennai City. However, he strongly opposed for the grant of bail to the petitioner stating that the present case was committed by the 2/4

accused only after giving a representation dated 24.04.2025 to the Commissioner of Police i.e. on 06.05.2025. He also submitted that the petitioner continuously involving himself in criminal activities and about more than 40 previous cases are pending against him including three murder cases. He further submitted that the first bail application filed before this Court in Crl.O.P.No.16286 of 2025 was dismissed on 09.06.2025.

5. Heard both sides and perused the materials available on record.

6. Considering the facts and circumstances of the case, the submission made by the learned counsel appearing on either side and taking note of the nature of allegations against the petitioner, this Court is not inclined to grant bail to the petitioner
