ORDER : The Court Made the following order :- The petitioner who was arrested on 18.09.2021 for the offence under Section 341, 147, 148, 324, 302 of I.P.C. in Cr.No.1019 of 2021 on the file of the respondent police, seeks bail. 2.It is the case of the prosecution that the petitioner along with the other accused is alleged to have committed murder of the deceased.

3.The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution. He would further submit that the petitioner has no previous bad antecedents and would further submit that the petitioner's name was not found in the F.I.R. and based on the confession of the co-accused, the petitioner was implicated in the case. He would further submit that the petitioner has to take care of his wife and two children and that the petitioner is in prison from 18.09.2021.

4.The learned Government Advocate (Crl. Side) would submit that this Court vide order dated 28.10.2021 dismissed the petition seeking bail in Crl.O.P.No.18435 of 2021 filed by the co-accused. 5.Considering the nature of the allegations levelled against the petitioner and since the petition seeking bail in Crl.O.P.No.18435 of 2021 filed by the co-accused has already been dismissed by this Court, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this criminal original petition is dismissed. -sd/- 29/10/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
