This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 18.06.2024, seeking bail in Crime No.42 of 2024 for the alleged offences punishable under Sections 408, 420, 477A & 120-B of IPC.
2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated in this case. He further submitted that the petitioner, who has nothing to do with the alleged offence, has been suffering incarceration from 18.06.2024. He also submitted that the co-accused in this case has been granted anticipatory bail by this Court and she is ready to abide by any stringent conditions that may be imposed by this Court, hence, he prayed for bail.
3. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that, the petitioner/A3, who was working as a front office staff in the de facto complainant's hospital, along with five other accused had illegally transferred the payments made by the patients into their respective accounts and misappropriated the funds of the hospital to the tune of Rs.1,26,72,334/-.

He further submitted that the petitioner herein alone has received a sum of Rs.20 lakhs as her commission and the investigation in this case is not yet completed and further, no recovery was made from the accused. Therefore, if the petitioner is released on bail, there is a possibility of her absconding and not available for further investigation. Hence, he objected for granting bail to the petitioner.

Taking into consideration the facts and the submissions made by the learned Government Advocate (Criminal Side) that the case is under investigation and the amount misappropriated by the accused was not yet recovered and also considering the gravity of the offence committed by the accused, this Court is not inclined to grant bail to the petitioner.
