O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing the first respondent to act upon the representation made by the petitioner on 27.01.2025 wherein the petitioner is seeking for including her name in the legal heirship certificate with respect to the deceased father Dhanasekaran.

2. Heard Mr.T.Indrachithu, learned counsel for the petitioner and Mr.G.Velu, learned Additional Government Pleader appearing for respondents.

3. The case of the petitioner is that Nandini/mother of the petitioner, was married to deceased Dhanasekaran and thereafter, the marriage was dissolved through a judgment passed by a competent Court. Thereafter, the petitioner's father re-married and through the second wife, he also had children. The petitioner's father died on 02.12.2024 leaving behind the petitioner, her mother and also the children born out of the second marriage.

4. The petitioner made a representation dated 27.01.2025 to the first respondent seeking issuance of legal heirship certificate by including the name of the petitioner. Since the same was not acted upon, the present writ petition has been filed.

In the considered view of this Court, if the petitioner wants the first respondent to issue the legal heirship certificate, the petitioner has to submit an online application by providing all the particulars and by paying the necessary charges. Only if an online application is submitted, the first respondent can act upon the same in line with the relevant Government Order. Merely sending a representation to the first respondent will not yield any result. Hence, it is left open to the petitioner to submit an online application to the first respondent with all relevant particulars and the first respondent shall act upon the same, conduct enquiry and thereafter, issue a legal heirship certificate. This writ petition is disposed of with the above direction. No costs.
