Application Nos.3870, 3871 & 3872 of 2021 in O.P.No.405 of 2020 V.PARTHIBAN,J.

The Application in A.No.3870 of 2021 is filed to condone the delay of 201 days in filing of the application to set aside the abatement caused due to the death of the deceased appellant; the Application A.No.3871 of 2021 is filed to set aside the abatement caused due to the death of the petitioner in the above said O.P., and the Application in A.No.3872 of 2021 is filed to bring the applicant on record as the contesting legal heir of the deceased petitioner.

2.This Court is satisfied with the reasons stated in the supporting affidavit. Accordingly, the Application No.3870 of 2021 to condone the delay of 201 days in filing the petition to set aside the abatement caused due to the death of the appellant is allowed and the delay is condoned. The abatement caused due to the death of the appellant is set aside and Application No.3871 of 2021 is allowed. Proposed Applicant is ordered to be brought on record as legal representative of the deceased and the Application No.3872 of 2021 is allowed.
